End User License Agreement (EULA)

This EULA agreement is effective from the date you first use the Software and shall continue until terminated. You may terminate it at any time upon written notice to HypeWolf OU / Motion.page. It will also terminate immediately if you fail to comply with any terms of this EULA agreement. Upon such termination, the licenses granted by this EULA agreement will immediately terminate, and you agree to stop all access and use of the Software. The provisions that by their nature continue and survive will survive any termination of this EULA agreement.

Definitions

  • “Application” refers to the Motion.page visual animation builder, including the desktop application, WordPress plugin, and any associated web-based tools. The Application is proprietary, paid software.
  • “SDK” refers to the @motion.page/sdk JavaScript package, distributed separately via npm. The SDK is free to use and is licensed under its own terms (the Functional Source License, Version 1.1, Apache 2.0 Future License — FSL-1.1-Apache-2.0), not under this EULA.
  • “Software” refers collectively to the Application and any associated files, documentation, and updates provided by Motion.page / HypeWolf OU, excluding the SDK.

License Grant

Motion.page / HypeWolf OU hereby grants you a personal, non-transferable, non-exclusive license to use the Motion.page Application on your devices in accordance with the terms of this EULA agreement.

You are permitted to load the Motion.page Application under your control. You are responsible for ensuring your device meets the minimum requirements of the Application. A stable internet connection is required for software authentication during loading. Without an internet connection, the Application will not function correctly.

The SDK

The Motion.page SDK (@motion.page/sdk) is a separate product licensed under the Functional Source License, Version 1.1, Apache 2.0 Future License (FSL-1.1-Apache-2.0). The SDK is free to use in your websites, applications, SaaS products, and client projects — whether commercial or not. The SDK is not governed by this EULA; its use is governed solely by the FSL-1.1-Apache-2.0 license included with the SDK.

The one restriction of the SDK license: you may not use the SDK to build a product that competes with Motion.page (for example, a no-code animation builder, visual animation editor, or similar tool). After two years from each release, the SDK code converts to the Apache License, Version 2.0 with no restrictions. Restrictions

With respect to the Application, you are not permitted to:

  • Edit, alter, modify, adapt, translate or otherwise change the whole or any part of the Application nor permit the whole or any part of the Application to be combined with or become incorporated in any other software, nor decompile, disassemble or reverse engineer the Application or attempt to do any such things
  • Reproduce, copy, distribute, resell or otherwise use the Application for any commercial purpose beyond its intended use
  • Allow any third party to use the Application on behalf of or for the benefit of any third party
  • Use the Application in any way which breaches any applicable local, national or international law
  • Use the Application for any purpose that HypeWolf OU considers is a breach of this EULA agreement

Intellectual Property and Ownership

Motion.page / HypeWolf OU shall at all times retain ownership of the Application as originally downloaded by you and all subsequent downloads of the Application by you. The Application (and the copyright, and other intellectual property rights of whatever nature in the Application, including any modifications made thereto) are and shall remain the property of Motion.page / HypeWolf OU.

Motion.page / HypeWolf OU reserves the right to grant licenses to use the Application to third parties.

Termination

Governing Law

This EULA agreement, and any dispute arising out of or in connection with this EULA agreement, shall be governed by and construed in accordance with the laws of Estonia, the Czech Republic, and the European Union.
